The prevalence of combined and septic sewer overflows in most US cities has led to numerous enforcement actions under the Clean Water Act (1972). Contemporary circumstances require a more comprehensive redress of violations due to CSO activity. The integration of green infrastructure with existing or adjunctive grey infrastructure can aid in a more sustainable way of carrying out negotiated orders under a CWA consent decree, simultaneously addressing: social equity, economic stabilization and development, and environmental quality. This presentation is an overview of a collaborative approach taken by Federal, State, and local authorities to negotiate a green-grey hybrid consent decree settlement in Cleveland OH; a contrasting example from Cincinnati OH; and description of follow-up research and development work to support implementation of the legal orders.
