Abstract |
Alternative dispute resolution (ADR) involves the use of third-party mediation, mini-trials and fact-finding. ADR is being used increasingly to resolve private commercial disputes. EPA is likewise applying forms of ADR in various contexts: negotiated rulemaking, RCRA citing, and Superfund remedial actions. ADR holds the promise of lowering the transaction costs to both the Agency and the regulated community of resolving applicable enforcement disputes. |
