ABC has a history of non-compliance with regulations contained in Chapter 4 of the Alabama Air Pollution Control Commission Rules and Regulations. As a result, the U.S. Department of Justice, at the request of the U.S. Environmental Protection Agency (EPA), commenced a civil action on November 8, 1977 in Federal District Court against ABC. The Alabama Air Pollution Control Commission Rules and Regulations cited in this report, with the exception of Section 4.9.4 which deals with pushing emissions, are part of Federally-approved Alabama State Implementation Plant (SIP). For pushing emissions, EPA Region IV, has cited ABC for violations of Section 4.4.1 of the Alabama regulations which is a Federally-approved mass particulate emission-limiting regulation based upon the process weight rate rather than the opacity of visible emissions. In December of 1977, at the request of the EPA Region IV, National Enforcement Investigations Center (NEIC) personnel inspected ABC to determine compliance with the Regulation 4.9. The results of that inspection are contained in this report. |
