Abstract Under section 112(d) of the Clean Air Act as amended in 1990 (the Act), the U.S. Environmental Protection Agency (EPA) promulgated national emission standards for hazardous air pollutants (NESHAP) for the magnetic tape manufacturing operations source category on December 15, 1994 (59 FR 64596). The final rule was codified as subpart EE to Part 63 of the Code of Federal Regulations (CFR). These national emission standards are technology based and are also known as maximum achievable control technology (MACT) standards. The standards apply to new and existing sources of hazardous air pollutants (HAP) as listed in section 112(b) of the Act. Section 112(d)(6) of the Act requires EPA to review and revise, as necessary (taking into account developments in practices, processes, and control technologies), emission standards promulgated under this section no less often than every 8 years. The NESHAP covers sources that are major sources of HAP. Major sources of HAP are those that emit, or have the potential to emit, 9.1 mega grams per year (Mg/yr) (10 tons per year (ton/yr)) or more of any one HAP or 22.7 Mg/yr (25 ton/yr) or more of any combination of HAP. The NESHAP also applies to any magnetic tape manufacturing operations located at a major source of HAP emissions (i.e., co-located emission sources), even if the magnetic tape manufacturing operations, by themselves, are not major sources of HAP emissions.
