The Hazardous Waste Civil Enforcement Response Policy (ERP) sets forth response guidance for violations occurring pursuant to RCRA where the State or EPA intends to pursue civil action, including administrative or judicial action. This revision includes changes to the definition of a Significant Non-Complier (SNC) by incorporating the 'Addendum to the 1996 Hazardous Waste Civil Enforcement Response Policy' that was issued on April 18, 2000. The addendum clarified the factors that should be considered in applying the three criteria for classifying a facility as a SNC. |
