Abstract On behalf of the states of Delaware, New Jersey and Pennsylvania, and in cooperation with the Delaware River Basin Commission, the United States Environmental Protection Agency Regions II and III (EPA) establish these total maximum daily loads (TMDLs) for polychlorinated biphenyls (PCBs) in the Delaware River Estuary. EPA establishes these TMDLs in order to achieve and maintain the applicable water quality criteria for PCBs designed to protect human health from the carcinogenic effects of eating the contaminated fish now found in the Delaware Estuary. In accordance with Section 303(d) of the Clean Water Act (CWA) and its implementing regulations, these TMDLs provide allocations to point sources (WLAs) discharging PCBs as well as allocations to nonpoint sources (LAs) of PCBs, and an explicit margin of safety to account for uncertainties. This TMDL report and its appendices set forth the basis for these TMDLs and allocations and discusses follow up strategies that will be necessary to achieve these substantial reductions of PCBs. EPA will continue to work with the Commission and the States to develop enhanced Stage 2 PCB TMDLs based on information to be collected and analyzed over the next several years.
