Abstract The Mound Plant, in Miamisburg, Ohio, is a facility formerly used by the Department of Energy (DOE) as an integral part of the nuclear weapons production complex. In 1994, DOE decided to end defense production activities at the site. The site is slated for industrial reuse; and such reuse has already commenced on portions of the site under the terms of a lease executed between DOE and a community development corporation in 1994. DOE is considering institutional controls to assure that future uses are compatible with cleanup decisions, in order to protect the public and assure the effectiveness of the cleanup remedies. In addition to DOE, the U.S. Environmental Protection Agency (USEPA) and Ohio EPA have identified cleanup objectives in connection with the cleanup of hazardous substance releases at the site under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA); the cleanup decisions being made under CERCLA also contemplate the use of institutional controls. The City of Miamisburg, citizen groups, and the community development nonprofit corporation that is guiding the Mound Plant reuse process (the Miamisburg-Mound Community Improvement Corporation) are also seeking the establishment of institutional controls that meet their respective objectives.
