The Water Quality Act (WQA) of 1987 added section 402(p) to the Clean Water Act (CWA). Section 402(p) of the CWA requires the Envrionmental Protection Agency (EPA) to establish phased and tiered requirements for storm water discharges under the National Pollutant Discharge Elimination SYstem (NPDES) program. On August 16, 1991 (56 FR 40948), EPA requested public comments on several regulatory and policy issues regarding NPDES permits for storm water discharges associated with industrial activity. On November 5, 1991 (56 FR 56549), the Agency also proposed extending the deadline for submitting part 2 of group applications for storm water discharges associated with industrial activity. In response to comment received on August 16, 1991, proposal, today's action describes a National Strategy for issuing NPDES permits for storm water discharges as associated with industrial activity. Today's action also contains a final rule that revises minimum NPDES monitoring requirements for storm water discharges associated with industrial activity. In addition, today's rule establishes minimum requirements for filing notices of intent to be authorized to discharge under NPDES general permits. Today's rule also establishes a deadline of October 1, 1992 for part 2 of group applications for storm water discharges associated with industrial activity. As noted above, this revised deadline was proposed on November 5, 1991. In connection with group applications, today's rule contains an amendment to clarify the minimum number of facilities that must submit sampling information in part 2 of a group application. Finally, today's action codifies several provisions of Section 1068 of the Intermodal Surface Transportation Efficienty Act into the NPDES regulations. Section 1068 of the Transportation Act addressed permit application deadlines for stor water discharges associated with industrial activity from facilities that were owned or operated by municipalities. |
