Abstract | As in Phase I and II, section 316(b) requirements for Phase III existing facilities would be implemented through the NPDES permit program. The proposed 316(b) rule for phase III existing facilities would establish performance standards similar to those that exist in the Phase II rule for Phase II existing facilities. The performance standards would consist of ranges of reductions in impingement mortality and/or entrainment (e.g., reduce impingement mortality by 80 to 95 percent and/or entrainment by 60 to 90 percent). These performance standards reflect the best technology available for minimizing adverse environmental impacts determined on a national categorical basis. The type of performance standard applicable to a particular facility (i.e., reductions in impingement mortality only or impingement mortality and entrainment) would be based on several factors, including the facility's location (i.e., source waterbody), and the proportion of the waterbody withdrawn. The proposed rule would establish requirements for new offshore oil and gas extraction facilities that are similar to requirements established under the 316(b) Phase I rule for other new facilities. |
