Abstract |
The goal of the module is to describe the liability enforcement, and settlement provisions of CERCLA. The module: lists the CERCLA enforcement mechanisms available to EPA; explains CERCLA sections 104 and 106 provisions; defines potentially responsible party; explains CERCLA section 107 liability; cites and locates the relevant CERCLA documents on enforcement and liability; explains the differences between administrative and judicial enforcement and settlement procedures; lists and compares the differences between enforcement authorities as they apply to removal and remedial actions; lists and key enforcement steps in EPA's response process; and specifies noncompliance penalties and provide statutory citations. |
