Abstract |
The report was undertaken to ascertain the legal theories under which pollution of groundwater is policed in Rhode Island. A study of that law indicated that the underlying legal theory is uncertain, so the author went on to suggest his own view of the situation--and to suggest a legal theory which would preserve the quality of the state's groundwater resources. The enforcement of present laws relating to such pollution was also studied in the field and through state records. The enforcement process was found ad hoc and not concerned with the upgrading and preservation of water quality. Water quality data is assembled, but little use is made of it by state officials. |
