Abstract
The objectives were to analyze the law pertaining to surface watercourses and groundwater in Nebraska and also to consider in depth the long-standing prohibition against interbasin transfers within the state. Consideration was given to the historical developmnet of Nebraska water statutes; leading Nebraska court decisions pertaining to groundwater, streams and preferences; major attempts to obtain legislative authorization for interbasin transfers in Nebraska; criteria for legislative delegation of authority to an administrative agency to grant permits for interbasin diversions; growing conflicts between well irrigators and stream appropriators and methods to integrate their uses; Nebraska's dual system of riparian and appropriative rights in streams; condemnation of agricultural rights for industrial uses inside and outside the territorial limits of municipalities; municipal groundwater supplies; conjunctive use; Nebraska's newly created 24 Natural Resources Districts which cover the entire state; and suggested powers for local districts.
