The EPA intends to propose this human health criterion in California in order to fulfill consultation obligations under the federal Endangered Species Act (ESA) stemming from promulgation of the California Toxis Rule in 2000. As part of that ESA consultation, the EPA agreed that the human health criterion should be sufficient to protect federally listed aquatic and aquatic-dependent wildlife species in California...
