Abstract
The document provides guidance to RCRA facility permit applicants and writers concerning the establishment of ACLs. To obtain an ACL, a permit applicant must demonstrate that the hazardous constituents detected in the ground-water will not pose a substantial present or potential hazard to human health or the environment at the ACL levels. ACLs are granted through the permit process under Parts 264 and 270, and are established in the context of the facility GWPS. The 19 factors or criteria, that are used to evaluate ACL requests are listed in Section 264.94(b) of the regulation. Detailed information on each of these criteria is not required in every ACL demonstration, because each demonstration requires different types and amounts of information, depending on the site-specific characteristics. A separate chapter of the document is devoted to each of these criteria. The criteria are briefly discussed, along with the type, quantity, and quality of information that should be provided, depending on the site-specific characteristics.
