David Gillies formed Fogging Solutions LLC, dba Mountain Fog, in March 2020 to provide fogging disinfection services for homes and businesses, including treating locations for COVID-19. The defendants used two products when they provided fogging disinfection services. They would first apply "Alpha," which they claimed would kill COVID-19. Their employees would then apply "Omega," which they claimed would kill COVID-19 on surfaces for 90 days after treatment. Mountain Fog's website claimed that "if someone coughs or sneezes, the droplets will fall out of the air over time and come in contact with the Omega treated surface. Upon contact, the microbe will be killed and the surface made safe." The defendants knew that Alpha and Omega were not approved by EPA to kill COVID-19. The defendants sold and provided fogging services on at least six occasions and received over $10,000 from customers.

David Gillies and Mountain Fog were sentenced to two years of probation, ordered to pay $11,970 in restitution, and a $10,000 fine.
