M. Cristo Inc. provides demolition services, asbestos removal, and other construction related salvage operations. The company is licensed by the New York State Department of Labor for the removal and disposal of asbestos-containing materials and its personnel are certified to handle asbestos removal and abatement.

On August 5, 2013, M. Cristo Inc. demolished commercial buildings located at 410 King Street in Troy, NY. The buildings contained a jurisdictional amount of regulated asbestos containing material. On August 6, 2013, an employee of the company prepared an Asbestos NESHAP Notification of Demolition and Renovation Form as required by federal law. On that form, the employee checked a box stating that asbestos was not present at 410 King Street. The employee also claimed that another section of the form was “not applicable” when asked specific questions about the types and locations of regulated asbestos material within the buildings to be demolished. This information was false at the time the document was prepared.

Knowing that the Asbestos NESHAP Notification of Demolition and Renovation Form prepared by the employee was false as to a material fact, M. Cristo Inc. filed the document with the United States Environmental Protection Agency, Region II Office, and violated federal law.

M. Cristo Inc., which was convicted of accessory after the fact to a false statement under the Clean Air Act, was fined $10,000.
