On or about June 19, 2012, Byron Stuckey stole an air conditioning unit from a house located in Wichita, Kansas. In doing so, the defendant removed the cover for the air conditioning unit and then cut the Freon line, which released HCFC22 into the atmosphere. HCFC22, more commonly known as Freon, is a Class II refrigerant and is known to cause a depletion to the earth's ozone layer. As a result, it is unlawful to release HCFC22 into the atmosphere. The defendant knowingly released the HCFC22, Freon, into the atmosphere when he cut the copper tubing refrigerant lines to the air conditioner he was stealing.

At the time of his federal indictment, Stuckey was in custody of the State of Kansas on related charges of theft and forgery.



August 3, 2017
Stuckey was sentenced to 12 months of probation on the federal charges.
