Boasso Savannah Shipping Terminal operates a tank cleaning company in Savannah, Georgia. In February 2015, approximately 90 drums and containers were dumped onto CSX railroad property and at other locations in and around Savannah. Labels on some of the drums and containers indicated the waste was generated by Boasso America Corporation. Some of the drums contained naphthalene, a known hazardous waste. Maurice Miller helped Ray Mitchell transport and dump the waste.

Miller, a former wastewater treatment plant employee, pleaded guilty to violating RCRA (42 U.S.C. § 6928(d)(1)).

In 2016, Mitchell pleaded guilty to a RCRA transportation violation and was sentenced to 28 months’ incarceration, followed by three years’ supervised release, and to perform 40 hours’ community service in addition to the restitution.

Maurice L. Miller was sentenced to 28 months’ incarceration, followed by three years’ supervised release. Miller also will perform 40 hours of community service and pay $58,050 restitution, jointly and severally to CSX Railroad, with previously sentenced defendant Ray F. Mitchell.
