Between 1999 and 2008, Cardington Yutaka Technologies (CYT) and its managers made false statements to the Ohio EPA and the village of Cardington regarding the discharge of industrial wastewater in the form of leak test fluid and parts washer water from the CYT facility to the village of Cardington’s Publicly Owned Treatment Works.

The case was investigated by EPA’s Criminal Investigation Division, the Ohio Environmental Protection Agency-Office of Special Investigations, and the Ohio Bureau of Criminal Identification and Investigation.

Wolf, Carroll and Razavi were all charged with violating the CWA {33 U.S.C. 1319(c)(1)(A) - knowingly violates}.

Cardington was charged with making false statements, a violation of 18 U.S.C. 1001.

In connection with a plea agreement, Wolf was charged in a superseding information with violating the CWA {33 U.S.C. 1319(c)(1)(A) - negligent violation}.

Wolf pled guilty to the charge.

September 12, 2012
Cardington pled guilty to 4 counts of false statements,

Carroll and Razavi were charged in a superseding information with violating the CWA {33 U.S.C. 1319(c)(1)(A) - negligent violation}.

November 28, 2012
Cardington was sentenced to 24 months probation and ordered to pay $1.2 million in federal fines, restitution to the Village of Cardington in the amount of $115,000 and a community service payment in the amount of $400,000 for the repair, maintenance, improvement and renovation of the POTW in the Village of Cardington. As a condition of the 24 month term probation, the company will comply with 12 terms and conditions set forth in the agreement, to include building a wastewater sampling/monitoring structure accessible by only the Village of Cardington POTW and Ohio EPA personnel and paying the cost of analysis for samples collected by the Village and Ohio EPA. They also must hire an environmental manager and conduct an environmental audit at the facility. The company will also pay a $1,600 special assessment.

Carroll pled guilty and was sentenced to 24 months probation, in which time he will serve 90 days home confinement, perform 500 hours of community service and was ordered to pay a $5,000 federal fine.

Razavi pled guilty and was sentenced to 3 months incarceration, 12 months supervised release, in which time he will perform 208 hours of community service and pay a $25,000 federal fine.

March 19, 2013
Wolf was sentenced to 12 months probation, in which time he will serve 30 days home confinement and pay a $500 fine.
