Parker was the principal operator of a septic hauling truck for a Broward County plumbing company and regularly pumped septic and grease trap waste for commercial and residential customers for discharge into the Broward County Water and Wastewater Services facility. Parker also participated in the process of converting sections of Ft. Lauderdale from a septic system to the city’s sanitary sewer system, which required pumping out and then abandoning the septic system before connecting to the city’s sanitary sewer system. During this conversion process, Parker also completed side-jobs which were not revealed to his employer. Although Parker’s employer had an account with the Broward County Water and Wastewater Services facility in Pompano Beach, where the septic and grease trap waste was supposed to be discharged, Parker discharged sewage originating from his side-jobs into the City of Ft. Lauderdale sanitary sewer system to avoid detection of his off-the-books work by his employer.

Parker was charged with 3 counts of violating the CWA {33 U.S.C. 1317(d) - operation in violation of standards}.

Parker pled guilty to all 3 counts.

BROWARD SEPTIC HAULER SENTENCED FOR ILLEGAL DISCHARGE OF WASTE

Wifredo A. Ferrer, United States Attorney for the Southern District of Florida, Maureen O’Mara, Special Agent in Charge, Environmental Protection Agency-Criminal Investigation Division (EPA-CID), Gregory Gibson, Assistant Director, Florida Department of Environmental Protection (DEP), Division of Law Enforcement, Franklin Adderley, Chief, City of Ft. Lauderdale Police Department, and Al Lamberti, Sheriff, Broward Sheriff’s Office (BSO), announced today that Daniel Parker, 35, of Ft. Lauderdale, was sentenced before U.S. District Court Judge Kathleen M. Williams, in Miami, for dumping pollutants into the City of Ft. Lauderdale Sanitary Sewer. Parker was sentenced to fifteen (15) months imprisonment and one (1) year of supervised release. Parker had previously pled guilty to a felony violation of the Federal Water Pollution Control Act, Title 33, United States Code, Sections 1317(d) and 1319(c)(2)(A).

The investigation and prosecution was the result of work by EPA-CID, DEP Division of Law Enforcement, the City of Ft. Lauderdale Police Department, and the Broward County Sheriff’s Office. Mr. Ferrer commended the investigative efforts of EPA-CID, DEP Division of Law Enforcement, the Ft. Lauderdale Police Department, and BSO. The case was prosecuted by Assistant U.S. Attorney Jose A. Bonau of the Economic and Environmental Crimes Section.
