From between on or about October 2005 and November 11, 2005, Brinkle supervised a work crew in retrieving barrels of hazardous waste from St. Louis. Brinkle admitted that he caused those drums to be transported to Kansas City, Missouri and dumped into a hillside adjacent to a tributary of the Little Blue River in Jackson County, Missouri.

Brinkle Construction Company was awarded contracts from AIMCO to conduct construction work at apartments AIMCO was provided HUD funds to renovate and remodel. Brinkle provided kickback payments to Christopher Grimsley in exchange for successful award of the renovation and remodeling contracts. The hazardous wastes illegally disposed of by Brinkle were generated from the renovations and remodeling at the apartment complexes.

EPA-CID and HUD OIG jointly investigated the possible unlawful use of federally subsidized funds discovered during the original investigation into various RCRA hazardous waste disposal violations. The joint investigation identified the individuals involved in the scheme to defraud HUD funds; Christopher Grimsley, Timothy Rowland, Bernie Belcher, Christopher Childers, Thomas Villirillo, JoDen Napper and Jamie Grimsley.

Brinkle was charged in an Information with one count of violating RCRA {42 U.S.C. 6928(d)(2)(A) - knowingly violates}.

He pled guilty to the charge.

February 9, 2010
Brinkle was sentenced to 60 months probation. No fine was imposed.
November 8, 2012
Belcher was charged with conspiracy, a violation of 18 U.S.C. 371.

Belcher pled guilty to the charge.

January 15, 2013
Childers was charged with conspiracy, and pled guilty to the charge.

March 29, 2013
Napper was charged with fraud, a violation of 18 U.S.C. 1341.

Napper pled guilty to the charge.

Tim Rowland was sentenced on one count of conspiracy and given 60 months probation, ordered to pay a $100 special assessment and $298,765 in restitution.

July 23, 2013
Childers was sentenced to 12 months probation and ordered to pay $179,570 in restitution - $65,046.70 to AIMCO; $111,655.70 to CRES Management; and $2,867.54 to MAXUS.

July 30, 2013
Belcher was sentenced to 60 months probation and ordered to pay $201,223 in restitution - $47,562 to AIMCO; $5,000 to CRES Management; $147,431.36 for Federal Insurance for CRES; and $1,230 to MAXUS.

August 28, 2013
Napper was sentenced to12 months and a day incarceration and ordered to pay $355,749 in restitution - $29,385.54 to CRES Management and $326,363.55 to MAXUS.

September 9, 2013
Villirillo and Grimsley were sentenced as follows:
  • Thomas Villirillo was sentenced to 60 months probation, ordered to pay a $100 special assessment and restitution in the amount of $105,560.
  • Jamie Grimsley was sentenced to 60 months probation, ordered to pay a $100 special assessment and $79,167 in restitution.
