Sunday sold Cardinal Plating to his son, who abandoned the business after it became insolvent. Freeman owned the premises occupied by Cardinal Plating, and enlisted Sunday to assist in clearing the premises for re-occupancy. Declining to pay for proper disposal of abandoned waste plating solutions and rinse waters, Freeman paid $500 to Crown for disposal of the wastes. Sunday, Freeman and Crown pumped the wastes into drums and a truck-mounted tank for removal from the premises. Crown transported some of the plating wastes to a Class II saltwater injection well, where they were disposed of; remaining wastes were disposed of by discharging onto several miles of county dirt roads from a truck-mounted tank.

Sunday was indicted on eight counts of violating RCRA {42 U.S.C. 6928(d)(1) - knowingly transports a hazardous waste to an unpermitted facility and 300h-2(b)(2) - unlawful disposal of waste in an Underground Injection Well.} Sunday pled guilty to three counts.

Sunday was sentenced to 16 months incarceration, 36 months probation and ordered to pay resitution in the amount of $52,496 to the U.S. EPA - Region 6 - Superfund Cost Recovery.

Freeman and Crown were indicted on eight counts of violating RCRA {42 U.S.C. 6928(d)(1) - knowingly transports a hazardous waste to an unpermitted facility and 300h-2(b)(2) - unlawful disposal of waste in an Underground Injection Well.} Freeman pled guilty to two counts of unlawful disposal of waste in an Underground Injection Well. Crown pled guilty to three counts; unlawful disposal and knowingly transports a hazardous waste to an unpermitted facility.

Freeman and Crown were each sentenced to 13 months incarceration on each count, to run concurrently, 12 months supervised release and ordered to pay retitution to the Superfund Cost Recovery in EPA's Region 6, in the amount of $52,496. The restitution is the responsibility of the three defendants, until it is paid entirely.
