The defendants were involved in the illegal dumping of waste re-bar, waste or excess concrete and waste cut-off bridge pilings into theEast Bay and Pensacola Bay during the construction of the Garcon Point Bridge, between January 1997 and March 1999. The dumping of construction wastes into bays can damage habitat for fish and other aquatic life.

Odebrecht was charged in an Information with three counts of violating the CWA {33 U.S.C. 1319(c)(1)(A) - negligently violates}. Doddi, Spry and Romero were each charged with one count of violating the CWA {33 U.S.C. 1319(c)(1)(A) - negligently violates}. Doddi, Spry and Romero pled guilty to the one count of CWA violation charged in the Information.

Odebrecht pled guilty to the three counts and was sentenced to pay $2,423,000 in restitution to the Garcon Point Restoration Trust for cleaning up and restoring the East Bay and Pensacola Bay, $42,000 to the Florida Department of Environmental Protection's Division of Law Enforcement, $20,500 to the Florida Fish and Wildlife Commission, $10,500 to the Florida Department of Environmental Protection's Submerged Land Section, $2,000 to the Okaloosa County Sheriff's Office and $2,000 to the Florida Fish and Wildlife Commission's Marine Patrol. Doddi and Romero were each sentenced to 36 months probation and ordered to pay a $1,000 federal fine.
