Permitting Authority Implementation Options
The Small MS4 Stormwater Program provides flexibility to the NPDES permitting authority. This flexibility can translate into several permitting and implementation options for operators of regulated small MS4s.
NPDES permitting authorities must issue permits for regulated small MS4s no later than December 9, 2002. NPDES permitting authorities can make as many as three permitting options available to operators of regulated small MS4s. Potential permitting options include:
- General permit
- Individual permit
- Modification of an existing medium or large MS4 permit.
Several potential implementation options are available to operators of regulated small MS4s. These options are intended to promote a regional approach to stormwater management that is coordinated on a watershed basis. Options include:
- Sharing responsibility for stormwater management program development with a neighboring regulated small MS4 operator;
- Taking advantage of existing local or State programs (i.e., relying on another entity); or
- Participating in the implementation of an existing medium or large MS4's stormwater management program as a co-permittee.
