EPA Regions 1, 2, 3, 5, 6, 7, 8, 9, and 10 today are issuing EPA's final NPDES general permit for discharges from large and small construction activities. Hereinafter, the
terms "permit" or "construction general permit" or "CGP" will replace "permits." This permit replaces the existing permit covering large construction sites in EPA Regions 1, 2, 3, 7, 8, 9 and 10 that expired on February 17, 2003 and the permit covering large construction sites in EPA Region 6 that expires July 6, 2003. This permit covers large construction sites in EPA Region 5. In addition, it incorporates coverage of small construction activity in EPA Regions 1, 2, 3, 5, 6, 7, 8, 9, and 10. It is similar to the 1998 permits and will authorize the discharge of pollutants in storm water runoff associated with construction activities in accordance with the terms and conditions described therein.

EPA Regions 1, 3, 6, 7, 8, 9, and 10 are issuing their 2008 National Pollutant Discharge Elimination System general permits for stormwater discharges from new dischargers engaged in large and small construction activities. Existing dischargers who properly filed an NOI to be covered under the 2003 CGP continue to be authorized to discharge under that permit according to its terms. The 2008 CGP contains the same limits and conditions as the Agency’s 2003 CGP with the exception of a few minor modifications. EPA is issuing this CGP for a period not to exceed two (2) years and will make the permit available to new construction activities and unpermitted ongoing activities only.

EPA Regions 1, 2, 3, 5, 6, 9, and 10 today are finalizing EPA's NPDES general permit for stormwater discharges from industrial activity, also referred to as the Multi-Sector General Permit (MSGP). The MSGP consists of thirty four (34) separate Regional EPA permits that may vary from each other based on State or Tribal water quality-based requirements. This permit replaces the existing permit that expired on October 30, 2005. As with the earlier permits, this permit authorizes the discharge of stormwater associated with industrial activities in accordance with the terms and conditions described therein. Industrial dischargers have the choice to seek coverage under an individual permit. An individual permit may be necessary if the discharger cannot meet the terms and conditions or eligibility requirements in the permit.

- Ninth Circuit Issues Opinion to Vacate 2006 Oil and Gas Rule (PDF)

On May 23, 2008, the Ninth Circuit Court of Appeals issued an opinion in Natural Resources Defense Council v. United States Environmental Protection Agency, No. 06-73217, vacating EPA's 2006 oil and gas construction stormwater regulation. This regulation effectively exempted from NPDES permit requirements stormwater discharges of sediment from construction activities associated with oil and gas exploration, production, processing, or treatment operations or transmission facilities unless the relevant facility had a discharge of stormwater resulting in a discharge of a reportable quantity of oil or hazardous substances. 40 C.F.R. §122.26(a)(2)(ii) (citing §122.26(c)(1)(iii)(C)). EPA promulgated this regulation to implement an amendment to the CWA enacted in the Energy Policy Act of 2005.

This notice serves as an announcement for plans to initiate national rulemaking to establish a comprehensive program to reduce stormwater discharges from new development and redevelopment and to make other regulatory improvements to strengthen the stormwater program. The purpose of this notice is to request input from the public to help EPA shape such a comprehensive program and to announce EPA’s intent to hold several public ‘‘listening sessions’’ in January 2010. Written comments must be submitted on or before February 26, 2010.
