EPA has developed an Electronic Notice of Intent (eNOI) system for pesticide Operators that need to submit Notices of Intent (NOIs) for coverage under EPA's Pesticide General Permit (PGP). The eNOI system is a free online service. Operators should use this system only if their pesticide discharges are located in a geographic area where EPA is the permitting authority. Who must submit an NOI?EPA has developed an interactive web tool to assist Operators in determining their requirements under the PGP, including whether or not they need to submit an NOI. Click here to access the interactive tool and also see Part 1.2 (174 pp, 1.3MB) of the permit to learn whether you need to submit an NOI to obtain coverage under the PGP. Note: While the permit requirements must be met as of October 31, 2011, Operators will be covered automatically under the PGP without submitting an NOI from all discharges prior to January 12, 2012. To continue coverage after January 12, 2012, those Operators who are required to submit NOIs will need to do so at least 10 days (or 30 days for discharges to National Marine Fisheries Service Listed Resources of Concern prior to January 12, 2012.
Will I receive acknowledgment that my NOI was received and granted?If the NOI is submitted electronically, the system will provide an immediate email confirmation to the certifying official that the NOI was received. EPA will provide separate notification within 30 days whether coverage has been granted or if further review is required. The status of a pending NOI can also be viewed on the eNOI system by clicking here. If the NOI is submitted in paper form, EPA will not provide confirmation of receipt. EPA will only provide direct notification of whether coverage has been granted or if further review is required. As soon as EPA processes a paper NOI and is pending authorization, the NOI can be viewed on the eNOI system by clicking here.
For what reason should an operator modify a NOI?The PGP requires Decision-makers to submit changes to previous NOI forms where, for example, coverage for an additional discharge not included in the original NOI is being requested. EPA expects these request for NOI changes to be submitted primarily in four instances: (1) coverage for a new or expanded pest management area is being requested, (2) discharge to a Tier 3 water is identified for permit coverage, or (3) discharge to any Waters of the U.S. containing National Marine Fisheries Service (NMFS) Listed Resources of Concern, as defined in Appendix A of the permit, is being requested or (4) changes in the treatment area, pesticide product, method or rate of application, or approximate dates of applications for discharges to Waters of the U.S. containing NMFS Listed Resources of Concern. In these four instances, Decision-makers are required to submit revised NOIs that reflect changes in the areas and types of activities for which coverage is being requested. Who must submit a Notice of Termination (NOT)?Any operator who was required to submit an NOI and meets the conditions of Part 1.2.5 (PDF) (174 pp, 1.3MB) of the PGP is required to submit an NOT to terminate coverage under this permit. NOTs can be filed through the eNOI system.
