Proposed Information Collection Request for stormwater rulemaking

EPA is currently developing a proposed rulemaking to strengthen its stormwater regulations and to establish a program to reduce stormwater discharges from developed sites. In order to collect data to inform this rulemaking, EPA has submitted a proposed Information Collection Request (ICR) to the Office of Management and Budget (OMB). The proposed ICR discusses the administration of multiple mandatory questionnaires:

  • questionnaires for the owners and developers of newly developed and redeveloped sites (includes short and long versions);
  • questionnaire for National Pollutant Discharge Elimination System (NPDES) permitting authorities.
  • questionnaires for the owners and operators of federally regulated and unregulated municipal separate storm sewer systems (MS4s); and
  • questionnaire for transportation-related MS4s (state, county, and local DOTs).

The data collected through this ICR will support EPA's rulemaking activities by providing the Agency with information to characterize:

  • scope, components, and implementation of existing local and state stormwater programs;
  • building, transportation and real estate projects including location, size, soil type, etc;
  • level of long term stormwater controls and best management practices (BMPs) at newly developed and redeveloped sites and retrofit of existing development;
  • burden and expenditures by states and MS4s associated with existing stormwater programs; and
  • technical, financial, and environmental data needed to quantify the incremental pollutant removals, compliance costs, and impacts for various regulatory options that EPA might consider.

The Federal Register Notice of this submission, published on May 10, 2010, has a 30 day comment period. This is the second opportunity for public comment on the proposed questionnaires, which EPA revised to address comments received during the first Federal Register comment period that ended on December 30, 2009.
