Applies only in areas where EPA Region 4 is the NPDES permitting authority (facilities located on Indian Country lands within the states of Alabama, Florida, Mississippi and North Carolina). Issued on March 10 and becomes effective on May 1, 2004. For other construction sites in the State of Florida, the Florida Department of Environmental Protection (FDEP) has a valid NPDES permit for facilities to receive coverage under. It is no longer necessary for those facilities to apply for coverage under an EPA issued general permit. EPA requested that the National Research Council (NRC) review its current permitting program for stormwater discharge under the Clean Water Act and provide suggestions for improvement. The broad goals of the study were to better understand the links between stormwater pollutant discharges and ambient water quality, to assess the state of the science of stormwater management, and to make associated policy recommendations.

Small construction sites can apply for a waiver from the stormwater permit requirements if the construction site has a low predicted rainfall potential where the rainfall erosivity factor (R Factor) is less than 5 during the period of construction activity. The Rainfall Erosivity Factor waiver uses this factor to determine whether the potential for polluted discharge is low enough to justify a waiver from permit requirements. This waiver is time sensitive and is dependent on when during the year a construction activity takes place, how long it lasts, and the expected rainfall and intensity during that time. This memo provides interim guidance on implementing the Stormwater Phase II program for Municipal Separate Storm Sewer Systems
(MS4s) in light of the recent decision by the U.S. Court of Appeals for the Ninth Circuit (Environmental Defense Center, et. al. v. EPA, September 15, 2003). The guidance covers several issues related to the implementation of the MS4 program, including public availability of NOIs, opportunities for public hearings, and review of NOIs by permitting authorities.

CAFOs and stormwater programs that have been issued Phase I or Phase II stormwater permits can not be defined as nonpoint source pollution and can not receive funding as a nonpoint source project. This memorandum clarifies that they are eligible for funding if the project is included in the state's approved National Estuary Program's Comprehensive Conservation and Management Plan (CCMP). Section 320 for CCMPs addresses estuary problems, and the Clean Water State Revolving Fund may be used to fund any or all of the projects identified in the plans to correct estuary problems. Examples of types of projects include wetlands purchase, septic system upgrades, stormwater system enhancements, and agricultural waste management systems, including manure containment ponds, loading, spreading, and injection equipment.

Memorandum from Ben Grumbles encouraging the further use of the Qualifying Local Programs (QLP) concept. QLP is part of the Phase II regulations that recognizes strong existing local sediment and erosion control programs, provides the opportunity to recognize other communities as they develop local sediment and erosion control programs in the future, and provides opportunities to streamline the regulatory process for construction site operators. A letter was sent to the EPA Regions and state permitting authorities to encourage the further use of this provision. This document includes a sample letter and attachment that was sent to EPA Region 1 and the state of Alabama.

- Municipal Separate Storm Sewer System (MS4) Program Evaluation Guidance
The MS4 Evaluation Guide is primarily for use by NPDES authorities to evaluate the quality of Phase I and Phase II MS4 programs, for permit compliance, technical assistance, and other purposes. It can be used for comprehensive program evaluations, or for certain components. It can also be used by MS4 program managers to evaluate their own programs.
EPA encourages state NPDES stormwater programs to adapt this Guide to their state programs. It is being provided in Word so that programs can incorporate state-specific program components into the Guide, and have a single manual for inspectors and others to use. EPA welcomes feed-back on the Guide based on experiences of state and regional evaluations. As state and EPA NPDES programs conduct more MS4 program evaluations we will undoubtedly learn a number of lessons about program evaluations. We are committed to making timely updates to the guide as the MS4 program evolves (EPA-833-R-07-003).

treat stormwater runoff before it is delivered to
the stream. It describes both off-site
storage and on-site retrofit techniques that can
be used to remove stormwater pollutants,
minimize channel erosion, and help restore
stream hydrology. Guidance on choosing the
best locations in a subwatershed for retrofitting

- Reducing Stormwater Costs through Low Impact Development (LID) Strategies and Practices
This EPA developed report contains 17 case studies from developments across North America that examines the economic viability of LID practices compared to traditional stormwater management design practices. It also highlights examples, where LID practices were shown to be both fiscally and environmentally beneficial to communities by reducing project costs and improving environmental performance. - NPDES Oil and Gas Public Meeting
On May 10th, 2005, EPA hosted a public meeting in Dallas, Texas to discuss the NPDES Stormwater Permit Regulations for Small Oil and Gas Construction Activities. EPA representatives included Jack Faulk, Jim Hanlon, Michael Lee, Deborah Nagle, and Jeff Smith. Jim Elder, an independent consultant, served as facilitator for the meeting. EPA created a panel of 11 representatives from state and federal government, the oil industry, and environmental organizations.

Currently there are thousands of Clean Water Act section 303(d) waters listed as impaired for stormwater-source pollutants such as pathogens, nutrients, sediments and metals. This Draft Handbook provides a technical reference for TMDL practitioners and NPDES permit writers on current methods being used to develop more detailed stormwater-source TMDL allocations, TMDL implementation plans including best management practices, and methods for translating TMDL allocations into NPDES stormwater permit requirements.

In 2005, EPA awarded a grant to the City of Denton, Texas, to monitor and assess the impact of gas well drilling on stormwater runoff, and to provide, if necessary, regulatory and management strategies for these activities. This study, completed in 2007, focused on three nearby gas well sites where pad construction and drilling were occurring. Runoff, primarily from the sites’ well pad areas, was monitored and analyzed, as were the contents of on-site drilling mud pits.

- Nationwide Urban Runoff Program (NURP): Final Report
The Nationwide Urban Runoff Program (NURP) was conducted by EPA and many cooperating agencies. NURP was established in 1978 as a 5-year program that examined:
