- Final Pesticide General Permit (PGP)
EPA issuance of the final National Pollutant Discharge Elimination System (NPDES) general permit for point source discharges to waters of the United States from the application of (1) biological pesticides, or (2) chemical pesticides that leave a residue. This permit, also known as the Pesticide General Permit (PGP), was developed in response to a decision by the Sixth Circuit Court of Appeals (National Cotton Council, et al. v. EPA).

The 2009 court decision did not affect the existing CWA permitting exemptions for agricultural runoff and irrigation return flow, both of which may contain pesticides, but do not require NPDES permits. Also, pesticide applications to land that do not result in point source discharges of pesticides to waters of the U.S. (such as for controlling pests on agricultural crops, forest floors, or range lands) do not require NPDES permit coverage. Therefore, many farms are not affected by the Court’s decision and do not need NPDES permits for their pesticide applications. This permit offers coverage for certain crops, such as cranberries, where the crops are grown directly in U.S. waters and pesticides are applied to those crops.

- National Marine Fisheries Service (NMFS) Listed Resources of Concern
Consistent with Section 7 of the Endangered Species Act (ESA), EPA consulted with the National Marine Fisheries Service (NMFS) and the Fish and Wildlife Service (FWS) to ensure that discharges and discharge-related activities covered under the Pesticide General Permit (PGP) are not likely to adversely affect species that are federally- listed as endangered or threatened (“listed”) or habitat that is federally-designated as critical (“critical habitat”), except as otherwise provided in the PGP.
As described in Step One of the Endangered Species Procedures in Appendix I of the PGP, Operators must determine whether any discharges from pesticide application activities overlap directly with any NMFS Listed Resources of Concern. Where those discharges overlap with NMFS Listed Resources of Concern, Decision-makers are required to submit an NOI certifying eligibility under one of the six criteria in Part 1.1.2.4 of the PGP. The files below contain maps of the four states with significant areas that contain NMFS Listed Resources of Concern. For discharges in those areas, Operators can view and search the NMFS Listed Resources of Concern information by county and watershed and in some instances, by stream name.

Any point source discharge of biological pesticides, or chemical pesticides that leave a residue, into waters of the United States (WOUS) must comply with the NPDES requirements. On October 31, 2011, the U.S. Environmental Protection Agency (EPA) issued a final NPDES Pesticide General Permit (PGP) that provides a mechanism for certain dischargers (i.e. Operators) to comply with this new requirement.

On January 7, 2009 the U.S. Sixth Circuit Court of Appeals held in National Cotton Council, et al, v. EPA, that the final rule was not a reasonable interpretation of the CWA and vacated the rule. Reversing EPA's November 2006 Aquatics Pesticides rule, the Sixth Circuit held that CWA permits are required for all biological pesticide applications and chemical pesticide applications that leave a residue in water when such applications are made in or over, including near, waters of the U.S. The court's decision, which applies nationally, is effective seven days after the deadline for rehearing expires or seven days after a denial of any petition for rehearing. Parties had until April 9, 2009 to seek rehearing
