The proposed new CGP includes a number of modifications to the 2008 CGP, many of which are necessary to implement the new Effluent Limitations Guidelines and New Source Performance Standards for Construction and Development point sources, known as the "C&D rule". The proposed CGP will be finalized prior to the expiration of the 2008 CGP (which EPA has proposed extending to January 31, 2012) and will provide coverage for eligible new and existing construction projects for a period of five years.

• Draft Report to Congress: Study of Discharges Incidental to Normal Operation of Commercial Fishing Vessels and Other Non-Recreational Vessels Less than 79 Feet

This study was conducted to meet the obligations of EPA under Public Law (P.L.) 110-299 (July 31, 2008). The law provided for a two-year moratorium on National Pollutant Discharge Elimination System (NPDES) permitting of discharges from commercial fishing vessels, regardless of size, and other non-recreational vessels less than 79-feet long that were subject to the 40 CFR 122.3(a) exclusion. This draft report summarizes the primary pollutant concentrations in the discharges sampled and evaluates the potential environmental impact of these discharges on large water bodies.

This permit also authorizes stormwater discharges from any other construction activity designated by EPA where EPA makes that designation based on the potential for contribution to an excursion of a water quality standard or for significant contribution of pollutants to waters of the United States.

• Agency Interpretation on Applicability of Section 402 of the Clean Water Act to Water Transfers (PDF) (19 pp, 1MB)

This memo addresses the question of whether the NPDES permitting program under Section 402 of the Clean Water Act is applicable to water control facilities that merely convey or connect navigable waters. It states that Congress generally intended for water transfers to be subject to oversight by water resource management agencies and State non-NPDES authorities, rather than the NPDES permitting program. This memo also states that the Agency will initiate a rulemaking to this effect; the Water Transfer Final Rule codifies this memorandum and clarifies that NPDES permits are not needed for water transfers.

EPA is issuing this interpretation of the Clean Water Act (CWA) to address issues regarding coverage under the CWA of pesticides regulated under the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA) that are applied to or over, including near, waters of the United States. This Memorandum is issued to address the question of whether National Pollutant Discharge Elimination System (NPDES) permits under section 402 of the CWA are required for the applications of pesticides that comply with relevant requirements of FIFRA. EPA provided public notice of and solicited public comment on its interpretation of the CWA with regard to this question.

EPA is seeking public comment on this draft notice which provides guidance to registrants on EPA's policy on labeling statements for pesticide products used for wide-area applications to control adult mosquitoes. The specific label statements and label organization principles recommended in this draft notice are intended to improve existing labels by clarifying language conveying environmental hazards posed by these products, as well as specific use directions and instructions to the applicators. The Agency believes that adoption of these recommendations will help pesticide users and pesticide enforcement officials to achieve more effective mosquito control and protection of public health, while ensuring that use of these products will not pose unreasonable risks to the environment. • Draft Policy on Blending at Sewage Treatment Facilities for Public Comment

Draft policy to establish consistent national guidelines on the practice of blending that is used by municipal sewage treatment facilities to manage high flows associated with storm events. Already widely used, blending is a technique to manage high flows that could damage sensitive parts of the sewage treatment system or could lead to overflows of raw sewage into local waterways. The draft policy outlines safeguards and requirements to be followed during blending and restates the requirement that all discharges must continue to meet Clean Water Act permit limits. The public comment period ends on January 9, 2004.

• Denied Petition Related to Ballast Water

EPA has denied a petition submitted by a number of environmental groups and other interested parties that sought to repeal provisions of EPA's regulations that cover certain discharges from vessels, including the discharge of ballast water. EPA has denied the petition for a variety of reasons, particularly because of the wide variety of regulatory and non-regulatory actions currently being taken by other federal agencies to address the potential introduction of invasive species from discharges of ballast water. Addresses two sets of circumstances for which EPA believes that the application of a pesticide to waters of the United States consistent with all relevant requirements of FIFRA does not constitute the discharge of a pollutant that requires a National Pollutant Discharge Elimination System (NPDES) permit under the Clean Water Act. These two cases are (1) the application of pesticides directly to waters of the United States in order to control pests (for example mosquito larvae or aquatic weeds that are present in the water) and (2) the application of pesticides to control pests that are present over waters of the United States that result in a portion of the pesticide being deposited to water bodies (for example when insecticides are aerially applied to a forest canopy where water may be present below the canopy or when insecticides are applied over water for control of adult mosquitos).

• NPDES General Permit for Stormwater Discharges From Construction Activities (CGP 2003)

This Construction General Permit (CGP) authorizes stormwater discharges from large and small construction activities that result in a total land disturbance of equal to or greater than one acre, where those discharges enter surface waters of the United States or a municipal separate storm sewer system (MS4) leading to surface waters of the United States subject to the conditions set forth in this permit. This permit also authorizes stormwater discharges from any other construction activity designated by EPA where EPA makes that designation based on the potential for contribution to an excursion of a water quality standard or for significant contribution of pollutants to waters of the United States. The CGP was modified on December 22, 2004. The files reflect that the permit and fact sheet were modified on December 22, 2004 and that the changes are effective on January 21, 2005. This permit replaces two permits issued in 1998 (63 FR 7858, February 17, 1998 for EPA Regions 1, 2, 3, 7, 8, 9, and 10 and 63 FR 36489, July 6, 1998 for EPA Region 6). Any references to the 1998 CGP in this permit refer to those two permits.

• Preliminary Data Summary of Urban Stormwater Best Management Practices

Developed by the Office of Science and Technology. EPA conducted a study of urban stormwater discharges in 1997-98 to explore how the Effluent Guidelines program can contribute to the Agency's efforts in implementing the national stormwater program requirements under Section 402(p) of the Clean Water Act. The study is intended to complement the ongoing implementation of the NPDES Stormwater permit program. The study is based largely on existing literature and data on best management practices (BMPs) that are used to control urban stormwater runoff. Topics covered include: BMP performance measures and measurable goals, availability of measurement methods, design criteria, monitoring issues, costs and cost minimization opportunities, and the benefits and economic impacts of constructing and operating BMPs.

The discussion of BMP performance includes structural BMPs such as infiltration devices, ponds, filters and constructed wetlands; and the effectiveness of non-structural BMPs, low impact development practices and management measures such as maintenance practices, street sweeping, public education and outreach programs. Literature sources include BMP performance studies compiled for the new National Stormwater BMP Database and BMP design manuals and guidance prepared by EPA and other Federal agencies, states and local governments (EPA-821-R-99-012).
