- Low Erosivity Waiver Certification for Stormwater Discharges Associated with Construction Activity
Small construction sites can apply for a waiver from the stormwater permit requirements if the construction site has a low predicted rainfall potential where the rainfall erosivity factor (R Factor) is less than 5 during the period of construction activity. The Rainfall Erosivity Factor waiver uses this factor to determine whether the potential for polluted discharge is low enough to justify a waiver from permit requirements. This waiver is time sensitive and is dependent on when during the year a construction activity takes place, how long it lasts, and the expected rainfall and intensity during that time. Note: Even though this publication is a PDF file, it allows you to type directly onto the form while it is open in the Adobe Acrobat Reader. You should enter your facility information on the form, print it, sign it, and mail it to the Stormwater NOI Center.

- Municipal Separate Storm Sewer System (MS4) Program Evaluation Guidance
The MS4 Evaluation Guide is primarily for use by NPDES authorities to evaluate the quality of Phase I and Phase II MS4 programs, for permit compliance, technical assistance, and other purposes. It can be used for comprehensive program evaluations, or for certain components. It can also be used by MS4 program managers to evaluate their own programs.
EPA encourages state NPDES stormwater programs to adapt this Guide to their state programs. It is being provided in Word so that programs can incorporate state-specific program components into the Guide, and have a single manual for inspectors and others to use. EPA welcomes feed-back on the Guide based on experiences of state and regional evaluations. As state and EPA NPDES programs conduct more MS4 program evaluations we will undoubtedly learn a number of lessons about program evaluations. We are committed to making timely updates to the guide as the MS4 program evolves (EPA-833-R-07-003).

Contains numerous fact sheets that describe best management practices (BMPs) that can be used to fulfill the 6 minimum measures described in the Stormwater Phase II Rule (public education and outreach on stormwater impacts, public involvement/participation, illicit discharge detection and elimination, construction site stormwater runoff control, post-construction stormwater management in new development and redevelopment, and pollution prevention/good housekeeping for municipal operations). Regulated small MS4s can select from the menu as they submit a notice of intent (NOI) to be covered by a general permit. It can also be used by states, the construction industry, and other stakeholders. Each fact sheet contains cost and effectiveness data, applicability, siting and design considerations, benefits, limitations, and case studies and resources for further information. Faced with rapid growth pressures and a burdened combined sewer system that frequently overflows, Sanitation District No. 1 in Northern Kentucky has identified land use policies and strategies that address stormwater concerns and create attractive, walkable neighborhoods. The handbook illustrates innovative site level design strategies that reduce runoff from development and how they could be successfully applied in Northern Kentucky. The strategies, policies, and designs, which are applicable elsewhere, provide communities in Northern Kentucky with environmentally responsible planning and design alternatives that can reduce water pollution, decrease runoff volume, protect aquatic habitat, and have the additional community benefit of creating more interesting places to live, work and play.

- Policy on Using the Clean Water State Revolving Fund to Finance Section 320 Comprehensive Conservation and Management Plan Projects
CAFOs and stormwater programs that have been issued Phase I or Phase II stormwater permits can not be defined as nonpoint source pollution and can not receive funding as a nonpoint source project. This memorandum clarifies that they are eligible for funding if the project is included in the state's approved National Estuary Program's Comprehensive Conservation and Management Plan (CCMP). Section 320 for CCMPs addresses estuary problems, and the Clean Water State Revolving Fund may be used to fund any or all of the projects identified in the plans to correct estuary problems. Examples of types of projects include wetlands purchase, septic system upgrades, stormwater system enhancements, and agricultural waste management systems, including manure containment ponds, loading, spreading, and injection equipment.

- Preliminary Data Summary of Urban Stormwater Best Management Practices
Developed by the Office of Science and Technology. EPA conducted a study of urban stormwater discharges in 1997-98 to explore how the Effluent Guidelines program can contribute to the Agency's efforts in implementing the national stormwater program requirements under Section 402(p) of the Clean Water Act. The study is intended to complement the ongoing implementation of the NPDES Stormwater permit program. The study is based largely on existing literature and data on best management practices (BMPs) that are used to control urban stormwater runoff. Topics covered include: BMP performance measures and measurable goals, availability of measurement methods, design criteria, monitoring issues, costs and cost minimization opportunities, and the benefits and economic impacts of constructing and operating BMPs.
The discussion of BMP performance includes structural BMPs such as infiltration devices, ponds, filters and constructed wetlands; and the effectiveness of non-structural BMPs, low impact development practices and management measures such as maintenance practices, street sweeping, public education and outreach programs. Literature sources include BMP performance studies compiled for the new National Stormwater BMP Database and BMP design manuals and guidance prepared by EPA and other Federal agencies, states and local governments (EPA-821-R-99-012).

- The Green Infrastructure Guide: Issues, Implementation Strategies and Success Stories
The Green Infrastructure Guide is a product of the West Coast Environmental Law Research Foundation in British Columbia. It provides guidance on how local governments may, using legal and policy strategies, encourage or require more sustainable infrastructure designs. It refers readers to strategies, and highlights case studies of local governments that have already taken steps to incorporate a green infrastructure approach. The focus is on implementation mechanisms, issues and barriers, and on what lessons have been learned from experiences to date.

- The Role of Local Governments in Implementing the NPDES Stormwater Program for Construction Sites
Provides local governments with a brief overview of the NPDES Stormwater Program on construction sites. Local governments can then provide this information to people in the construction industry who might need NPDES permit coverage. Stormwater permits require many operators of construction sites to implement steps to prevent sediment and other pollutants from washing off into nearby streams, rivers, lakes, and coastal waters.

- Urban Stormwater BMP Performance Monitoring
Developed by the Office of Science and Technology. This manual provides targeted practical assistance in conducting water quality monitoring and reporting data that are useful for assessing effectiveness of stormwater best management practices (BMPs). It was developed by integrating experience gleaned from field monitoring activities conducted by members of the ASCE Urban Water Resources Research Council and through the development of the ASCE/EPA National Stormwater BMP Database.
This document helps achieve stormwater BMP monitoring project goals through collection of more useful and representative rainfall, flow and water quality information .
Provides a recommended set of protocols and standards for collecting, storing, analyzing, and reporting BMP monitoring data. It provides insight into and guidance for strategies, approaches, and techniques that are appropriate and useful for monitoring BMPs (EPA-821-B-02-001).

- Water Quality Scorecard
EPA's Water Quality Scorecard was developed to help local governments identify opportunities to remove barriers, and revise and create codes, ordinances and incentives for better water quality protection. It guides municipal staff through a review of relevant local codes and ordinances, across multiple municipal departments and at the three scales within the jurisdiction of a local government (municipality, neighborhood, and site), to ensure that these codes work together to protect water quality goals. The two main goals of this tool are to: (1) help communities protect water quality by identifying ways to reduce the amount of stormwater flows in a community and (2) educate stakeholders on the wide range of policies and regulations that have water quality implications.
The scorecard is intended for municipalities of various sizes in rural, suburban and urban settings, including those that have combined sewers, municipal separate storm sewers and those with limited or no existing stormwater infrastructure. It can help municipal staff, stormwater managers, planners, and other stakeholders better understand where a municipality's land development regulations and other ordinances may present barriers or opportunities to implementing a comprehensive water quality protection approach. The scorecard provides policy options, resources and case studies to help communities develop a comprehensive water quality program.
