The defendants failed to obtain a permit in October 2009 for asbestos abatement related to renovations they were performing at the Holiday Inn located at 1129 North Summit Boulevard in Frisco. Once the Colorado Department of Public Health and Environment learned of the renovations, which resulted in asbestos contaminating rooms at the hotel, they prohibited the owner of the hotel from renting out the affected rooms.

Despite the prohibition the owner of the hotel, is suspected of ordering the housekeeping staff to clean the affected rooms. According to the indictment, in addition to exposing the housekeeping staff to the asbestos contamination, they continued to rent out the rooms to unsuspecting guests.

Semenship, Gora, Para and NVH Construction were charged with 3 counts of violating state environmental regulations {Causing and Contributing to a hazardous substance incident, a violation of C.R.S. 29-22-108; and violations of the Air Quality Control Act - knowing endangerment, a violation of C.R.S. 25-7-122.1(3)(a)}.

New Vision was charged with 2 counts of violating state regulations {Count 1 - causing and contributing to a hazardous substance incident and Count 2 - knowing endangerment}.

New Vision pled guilty to both counts.

October 3, 2011
Semenshin and NVH pled guilty to all 3 counts charged and were sentenced as follows:
  • Semenshin was ordered to pay a $500 state fine and $156 in restitution
  • NVH was sentenced to pay $30,156 in restitution
New Vision was sentenced to pay restitution in the amount of $50,326.

March 19, 2012
Gora and Para pled guilty to one count of violating C.R.S. 29-22-108(1). All other charges were dismissed.

March 19, 2012
Gora and Para recieved a deferred sentence - 12 months probation and ordered to pay, joint and several restitution in the amount of $1,218.71.
