Calvin Burks, owner of J &C Environmental Services, Inc., which performs asbestos inspections in the St. Louis, Missouri, metropolitan area, was sentenced on March 9, 2009, in federal district court for the Eastern District of Missouri to one year in prison for creating a fictitious asbestos inspection report on a building to be demolished in the city of St. Louis.

From approximately April 2008 through May 2009, Burks performed over 100 asbestos inspections of buildings in St. Louis that were to be demolished and charged a fee for the inspection and the analysis of suspect asbestos material. Approximately 108 of the inspection reports Burks provided to the demolition contractors and/or building owners contained sample analyses which were on letterhead of Precision Analysis Testing Laboratory even though Precision Analysis had not conducted the asbestos analysis or testing. Burks copied the Precision Analysis letterhead from a previous job and falsified the additional information provided in the approximately 108 reports, including the sample analysis of suspect asbestos material. Burks charged approximately $150 for the fraudulent inspections and sampling analysis.

Burks was charged with three counts of making false statements, a violation of 18 U.S.C. 1001.

He pled guilty to the charges.

Burks was sentenced to 12 months incarceration, 36 months probation and ordered to pay restitution in the amount of $16,800 to the City of St. Louis.

LOCAL ASBESTOS INSPECTOR SENTENCED FOR MAKING FALSE INSPECTION REPORTS

St. Louis, MO: The United States Attorney’s Office announced today that Calvin Burks was sentenced to one year in prison for creating a fictitious asbestos inspection report on a building to be demolished in the City of St. Louis.

Calvin Burks, owner of J &C Environmental Services, Incorporated, St. Louis, conducts asbestos inspections in the St. Louis metropolitan area.

According to court documents, from approximately April 2008 through May 2009, Burks performed over 100 asbestos inspections of buildings in the City of St. Louis that were to be demolished and charged a fee for the inspection and the analysis of suspect asbestos material. Approximately 108 of the inspection reports Burks provided to the demolition contractors and/or building owners contained sample analysis which were on letterhead of Precision Analysis Testing Laboratory in St. Louis, even though Precision Analysis had not conducted the asbestos analysis or testing. Burks copied the Precision Analysis letterhead from a previous job and falsified the additional information provided in the approximately 108 reports, including the sample analysis of suspect asbestos material.

Burks charged approximately $150 for the fraudulent inspections and sampling analysis, which were then relied on by building contractors and owners when submitting asbestos NESHAP (National Emission Standards for Hazardous Air Pollutants) notification of demolition and renovation to the City of St. Louis. Based on this notification the City of St. Louis subsequently issued a demolition permit authorizing demolition, to include a property located at 6257-6259 Gravois, St. Louis, Missouri.

CALVIN BURKS, St. Louis, pleaded guilty last December to one felony count of making false statements, and he appeared today for sentencing before United States District Judge Carol E. Jackson.

This case was investigated by Region 7 U.S. Environmental Protection Agency Criminal Investigation Division and the Missouri Department of Natural Resources. Special Assistant United States Attorney Anne Rauch handled the case for the U.S. Attorney’s Office.
