HPI is a pesticide company located in St. Joseph, Missouri. HPI violated a number of laws including the Resource Conservation and Recovery Act (RCRA) and the Clean Water Act (CWA) in their attempts to store and dispose of waste generated from their pesticide manufacturing process. HPI has illegally stored hazardous waste at a number of different locations and disposed of waste pesticides into the sewer system.

The defendants were charged with violations of the CWA {33 U.S.C. 1319(c)(2)(B) - knowingly introduces into a sewer system or into a publicly owned treatment works any pollutant or hazardous substance...} and RCRA {42 U.S.C. 6928(d)(2)(A) - knowingly violates}.
June 12, 2009
Nilesen pled guilty to violating FIFRA and was sentenced to pay a criminal penalty.
September 1, 2009
Garvey pled guilty to one count and was sentenced to 12 months incarceration and ordered to pay a $100,000 federal fine.
March 23, 2010
HPI pled guilty to one count of violating RCRA and was sentenced to pay a $300,000 federal fine.
