Mark Banskter was sentenced to 10 months in prison and to one year probation after pleading guilty to violating the Clean Air Act by falsifying required auto emission tests conducted by the Gateway Vehicle Inspection Program, St. Louis, Missouri. He fraudulently tested multiple vehicles whose owners paid him to pass the emissions test. Defendants Michael Terry and James Dubose each received one year probation for their involvement.

September 24, 2008
The defendants were charged in an Indictment as follows: Dubose was charged with one count of making false statements, a violation of 18 U.S.C. 1001(a)(3); and three counts of violating the CAA {42 U.S.C. 7413(c)(2)(A) - knowingly makes false statements}. Banskter and Terry were each charged with two counts of knowingly making false statements under the CAA.

February 26, 2009
Terry pled guilty to the two counts and was sentenced to 12 months probation. No fine was imposed.
March 31, 2009
Banskter pled guilty and was sentenced to 10 months incarceration and 12 months probation. No fine was imposed.
September 14, 2009
Dubose pled guilty and was sentenced to 12 months probation. No fines were imposed.
