Fleetwash, Inc., a corporation affiliate of Professional Mobile Cleaning, Inc., had a contract with the U.S. Postal Service to clean postal vehicles in Memphis and Knoxville, Tennessee and in Atlanta, Georgia. Due to an equipment malfunction, on April 2, 2003, wash water and detergent were allowed to be discharged into a storm sewer in Memphis which emptied into the Mississippi River.

The defendant pled guilty to the charge and was sentenced to pay a $125 special assessment fee and a $1,000 federal fine. In addition, in lieu of a larger fine, the defendant agreed to pay a total of $200,000, including $140,000 to the U.S. Postal Service, $20,000 to the Tennessee Wildlife Resources Agency, $20,000 to the Tennessee Department of Environment and Conservation, $20,000 to the Tennessee Bureau of Investigation and $20,000 to the Tennessee Attorney General's Office.
